Confidentiality and Data Protection Policy

MAGNA PRODUCTIONS, S.L. (henceforth the Entity) is committed to due diligence and compliance with Data Protection regulations. As a main concept of this duty and commitment, the Data Protection Channel (ETHIC line), which embodies the fundamental elements of Data Protection, which is managed, supervised and accredited by BONET consulting, a company that specialises, and is a leading player, in Regulatory Compliance and Data Protection.

Below, detailed information about the confidentiality and Data Protection is displayed in compliance with the provisions of article 13 of Regulation (EU) 2016/679 of the European Parliament and Council, of 27th April 2016, regarding the protection of physical persons with respect to the processing of personal data and the free circulation of this data (General Data Protection Data or GDPR).

Purposes of the processing

The Entity will process the information provided by interested parties for the following purposes:

  • To manage the attention they receive, their visit to, and meeting at, our premises.
  • To manage any type of request, suggestion or petition about our professional services formulated by interested parties.
  • To formalise and fulfil contractual relationships and other administrative activity linked to the different services offered by Traffic Models as representative in the relationships of the models with customers and other interested parties.
  • To inform about activities, articles of interest and general information relating to our activity and services.
  • To manage data provided by candidates for a job opportunity by means of their CV for the purpose of the selection and recruitment process.
  • To comply with other authorised purposes or those required by law, such as, for example, to prevent a threat to life, health or safety or to assert our legal rights.

For the success and development of the attention he/she receives and the management of the above purposes, the holder consents for his/her data to be processed for the above purposes, all in strictest compliance with Data Protection regulations and the policy explained herein. You can exercise your rights at any time (see specific section).

Data conversation criteria

  • Management of services contracted with the Entity: personal data provided in contracts, offers and/or service proposals, as well as those of all other persons whose involvement may be required, will be kept during the period that the contracted services are in force. Once the contracted service(s) has(ve) been provided, personal data will be kept only in the event that it might result in liability for the Entity and/or to comply with other legal frameworks that may apply to the Entity, or with a regulation having the force of law that requires these to be kept. Personal data will be kept in a way that enables identification and the exercise of the Rights of the affected parties, and according to the legal and organisational technical measures that may be required to guarantee the confidentiality and integrity of them.
  • CV Management: as a general rule, the Entity keeps your CV for the maximum term of one year; once this period ends, it will be automatically eliminated, according to the principle of data quality.
  • Other: all other data and information provided by the user by any means will be kept for as long as necessary to fulfil the purpose for which they were gathered.

Legitimisation

The legal basis enabling the Entity to process the personal data of users, customers and potential customers is:

  • The consent of interested parties for the processing and management of any request.
  • The consent given by candidates for job opportunities for selection and recruitment purposes.
  • The framework for the provision and/or contracting of services with the Entity.
  • The legitimate interest for sending you informative, commercial communications and/or promotional offers relating to the activity of the Entity, and services contracted by email or any other means.

Recipients

The Entity, when required for the management of purposes inherent to the development and execution of the services provided when it is an obligation imposed by a regulation having the force of law, will pass on your data to different third parties, such as modelling agencies, private professionals, commercial brands, producers, as well as other third parties.

Provenance

Personal data is obtained directly from interested parties and our collaborators. The categories of personal data our collaborators provide us with are the following:

  • Identification data.
  • Postal or email addresses.
  • Physical characteristics.
  • Image.
  • Data provided by and/or consented to by the interested parties themselves relating to, and required for, the management and performance of the service we provide.

Rights

Right of Access, Rectification and Elimination: interested parties have the right to get confirmation about whether we at the Entity are processing the data concerning them, as well as to request rectification of inaccurate personal data, or request their elimination when, among other reasons, the data are no longer required for the purposes for which they were collected.

Right of Limitation and Opposition: in certain circumstances, interested parties can request the limitation of the processing of their data, in which case we will only keep it for the exercise or defence of claims. In certain circumstances and for reasons relating to their particular situation, interested parties can oppose the processing of their data. In this event, the Entity will stop processing, except for compelling legitimate reasons or the defence of possible claims.

Data Protection Channel / DATAPROTECT - line

The Entity has implemented a Data Protection Channel, envisaging the utmost commitment, rigour and professionality in matters of security, experience, independence, and know-how in the processing of the communications received.

The Data Protection Channel has been implemented through a web platform, developed and managed by an external independent expert to fulfil and guarantee our previous commitments.

By means of the Data Protection Channel, you can communicate and process the exercise of your Rights (see previous section), notify any evidence or awareness of there being any possible violations (breaches) of security and/or possible non-compliance with, or irregularities concerning, Data Protection regulations or policies/ commitments of the Entity in this matter.

Attention and support

Interested parties can notify the Entity of any query regarding the processing of their personal data or interpretation of our policy by contacting the person Responsible for Data Protection (RDP) at the address indicated at the start of this policy.
